IMPORTANT INFORMATION ON HOW
OVERTIME SHOULD BE CALCULATED
FOR OPC AND GREETER EMPLOYEES

          This office is advised that OPC and Greeter employees receive a small hourly wage (perhaps $8.00 an hour) and make most of their pay from the "commissions" (booking fee) paid to them for each qualified tour they place.  When those persons work overtime their overtime rate, if even paid by Westgate, has in the past only been paid based upon their "hourly" pay, not including their booking fee pay.  This means an OPC paid $8.00 an hour plus booking fees would only be paid overtime at $12.00 an hour.   It is believed this method of paying overtime is incorrect and the "overtime rate" must be based upon BOTH the hourly pay AND the booking fee pay.  This means the overtime rate of OPC and Greeter employees may be much higher than the rate Westgate paid them.  The best way to understand this is by an example:

         An OPC works 50 hours.  They earn $8.00 in "hourly pay" and $1,000 in booking fees for the week.  Their total earnings, before figuring overtime pay, are $1,400 (50 x $8.00 an hour plus $1,000).  Their "hourly rate" for overtime purposes is based upon that entire $1,400 divided by the 50 hours they worked, which is $28.00 an hour.  This means they should have been paid 10 hours of overtime at $42.00 an hour (based upon an hourly rate of $28.00 an hour) and NOT 10 hours at $12.00 an hour (based upon an $8.00 hourly rate).  If Westgate in this example had paid the OPC 10 hours of overtime at $12.00 an hour they would still owe the OPC another $300.00 for the week (the difference between the overtime rate Westgate paid, $12.00 an hour, and the rate it should have paid, $42.00 an hour, is $30.00 an hour).

          This office is also aware of claims that Westgate failed to properly record overtime hours worked.  This office is attempting to collect for those "unrecorded" overtime hours and Westgate's failure to properly record those hours does NOT prevent the Court from awarding employees overtime for those hours.

COMMISSIONS OWED TO OPC EMPLOYEES

This office is aware of claims that Westgate did not pay all commissions it owed to OPC employees.  This includes claims Westgate lied about tours being "unqualified" and refused to pay commissions (booking fees) to OPC employees.  This office is investigating those claims and is attempting to have the Court force Westgate to pay any unpaid commissions to its OPC and Greeter employees.  Do NOT contact this office at this time about those claims.
